Terms of Use

These terms of use apply to your use of the website of Sunday (www.mysunday.love - hereafter the "Website") and Sunday mobile application (iOS/Android- hereafter the "App").

Please go through them carefully.

Acceptance of Terms of Use Agreement

We reserve the right, at our discretion, to make changes to the terms of use at any time.It is the responsbility of the user to check the updated terms which shall be published on our Website as well as the App. If the user continues to use our services either through Website or App, it shall be construed as their acceptance of the terms.

Eligibility

Sunday is a platform to connect and facilitate meaningful relationships between individuals seeking love. To make an account on Sunday:

- You must be at least 18 years of age

- You must be eligible to enter into a binding contract with Sunday

- You must be looking for love or meaningful relationships

- You are not barred from using the Service under any jurisdiction worldwide

- You will not use our Website or App if you have been banned from our platform (Website/App)

‍

- You do not appear on the U.S. Treasury Department's list of Specially Designated Nationals or face any other similar prohibition

‍

- You will comply with this agreement and all applicable local, state, national and international laws, rules, and regulations

- You are not a citizen of a country declared as enemy by the Union of India

- You are not an illegal foreigner residing in India

In case of any of the conditions having not met, Sunday holds the discretion to remove your account from its platform and ban you from using its services.

Governing Law

These terms of use and privacy policy shall be governed in all respects by the laws made by the Union of India and States, whilst you agree to submit to the jurisdiction of the state high court of Sunday’s place of incorporation.

Registration and Your Account

If you want to use the Website or App, you first need to register. The process to register is different for men and women. While women need to authenticate themselves through a KYC verification, men need an invite from a KYC-verified woman on our platform. Further, both men and women would need a Google or Apple account to register themselves successfully on the platform.

After registering, you can create your personal account ("Your Account") with your images and other verifiable information. Your Google/Apple account will serve as your identifier while contacting support.

The registration of Your Account qualifies you as a user. However, you can be suspended if we detect any unusual activity from your account or receive negative feedback from other users.

Sunday does not accept any responsibility for the login credentials used to sign in to the service. You accept sole responsibility for all activities undertaken through your account, and hence are required to protect your credentials.

If your login credentials have been leaked or you believe that there is suspicious activity from your account, you’re obligated to contact Sunday through our support in the first instance, and can ask for deletion of your profile by writing a mail to us.

Community Guidelines

You agree to receiving emails and information through other means of communication by Sunday by using our Services. We aim to keep our platform free from users feigning interests and misusing our services with a malicious intent.

Thus, the following is expected from all the users:

- You will not post, or share with other users, any defamatory, inaccurate, abusive, obscene, offensive, sexually oriented, threatening, racially offensive, or illegal material, or any material that infringes or violates another party's rights.

- You will not use Sunday for promotion of any kind, or for business/commercial activities.

- You will not provide inaccurate or false information to Sunday, and are obligated to provide proof for any information, if mandated by Sunday.

- You will not share malicious links with other users.

- You are not permitted to share your login credentials with others.

- You should be mindful of the language used and the information shared with other users on our platform. Further, you must keep in mind the privacy of yourself and others while talking to other users.

- Your account may be terminated if you indulge in any of the following activities or if Sunday receives negative feedback from other users.

- Your photos will be reviewed before getting published on your profile.

- You will not upload viruses or other malicious code or compromise the security of the services offered by Sunday in any way.

- You will not post content that is violative of Intellectual Property Rights (IPR) of you, any other user, Sunday, or any third-party.

- You will abide by all the laws and regulations of the country and the state of your residence, and shall behave in a respectful manner with other users so as to not violate their rights.

- You will not infringe upon the normal running of Sunday or its infrastructure in any way.

- You will respect the wishes of other users and cease communication the very moment one desires so. Further, you shall not stalk, harass, or troll the users in any way.

- You agree to compensate us for any claim or damages (including any legal fees in relation to such claim or damages) demanded by a third party in respect of any matter relating to or arising from any breach or suspected breach by you of these terms of use or the rights of a third party. We reserve the right to issue warnings, suspend access to Your Account or terminate Your Account, if we reasonably consider that you are in breach of these terms of use.

Sunday provides assistance and guidance through its customer care team. When communicating with us, you agree to not be abusive, obscene, profane, offensive, sexist, threatening, harassing, racially offensive, or indulge in any other inappropriate behaviour.

Sunday reserves the right to investigate and/or terminate your account without any refund or reimbursement if we feel you have misled Sunday or its users, or misused the Service, or behaved in a way that Sunday regards as inappropriate or unlawful, including actions or communications that occur off the service involving users you met through Sunday.

Safety

Sunday aims to keep the platform free from people with malicious intent. Thus, it shall seek proof of any information provided by the users on the platform. However, this policy is merely to add filters for better safety rather than to take the onus of verifying claims of the users or conducting a background check. You are solely responsible for taking all appropriate safety precautions in connection with the use of the website and app and contacting other users. Further, you accept that there are risks associated with online or offline interactions with people (including going on dates) inclusive of the platform’s users. Thus, no rights can be derived from the steps taken by Sunday for your safety.

Sunday is constantly evolving with continuous feedback and the website or app may not be available in a fully operational condition.

Any decision taken by you based on the information provided on our Website or App is at your own risk.

Sunday does not allow minors to make an account on its App. If a minor uses fraudulent means to make an account on Sunday and claims to be of legal age, their parents should inform Sunday immediately by contacting us through email and request for the deletion of their profile and data. We shall do so as soon as possible.

License

The rights granted by Sunday to the user are for private and personal use only. They are non-transferable.

As a user of Sunday, you grant Sunday a free-of-charge, non-exclusive, international and permanent license for the use, reproduction, representation, modification and translation of any basic intellectual property-related component (text, photos, videos etc.) that it may provide through the App for the non-exclusive purpose of communicating with other users. It can use such content in any format on its Website, App, Ads, or for internal communication.

Sunday reserves the right to modify or discontinue any service provided at any given point of time. It shall not be liable to any third-party for any modification or discontinuance of its services.

Deletion of Account

A user of Sunday can decide to delete their account at any given point in time by contacting Sunday through email and requesting the deletion of their account.

If a user chooses to delete their account, their profile will be removed from the list of profiles shown to other users and they would have to register again to make a new profile.

Sunday reserves the right to terminate, ban, shadowban, or delete a profile in case of any breach of terms with or without notice. Further, Sunday can disable access to any of its services or functionalities to a user as per its discretion if it prima facie detects any anomalous behaviour/activity.

Copyright Infringement Claims

Prior consent is required from the owner of any copyrighted material, trademarks, or other proprietary information before posting, distributing, or reproducing such material.

If the owner of such proprietary material believes that their rights are violated, they may contact Sunday through email with the following information:

- Description of the material in question

- Any link or location to where the copyrighted material is located on the App

- Your ownership proof of the material in question

- A statement with a digital or physical signature under the penalty of perjury that the above information is accurate and that you are the rightful owner of the copyrighted content.

External Links and Services

Since Sunday has no control over the content available on the internet, it shall not be liable, directly or indirectly, for any right infringed or loss incurred by accessing a link shared on its platform, or accessed through it.

Further, in case Sunday enters into an agreement with a third party for promotions, the users are obligated to read their terms and conditions/terms of use before entering into any contract with them or availing their services.

Limitation of Liability and Disputes

Users are solely responsible for their safety on the platform and should interact with users keeping that in mind. While Sunday reserves the right to take action against any party in any dispute, it is not obligated to.

In no event shall Sunday, its affiliates, employees, agents, licensors or partners be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the service, including without limitation, bodily injury, emotional distress, loss of use, loss of data, loss caused by a computer or electronic virus, loss of income or profit, loss of or damage to property, wasted management or office time, breach of contract or claims of third parties or other losses of any kind or character, even if Sunday has been advised of the possibility of such damages or losses, arising out of or in connection with the use of Sunday and/or any other damages resulting from communications or meetings with other users of this service or persons you meet through this service.

Any charge for SMS, or internet services used for sending an invite to Sunday shall be borne by the inviter.

Sunday does not make any warranties or representations (neither explicit nor implied) with respect to the Website, App, or the associated services.

You expressly understand and agree that Sunday will not be liable for direct, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, resulting from: a) the use or inability to use the website or app; b) the cost of procurement of substitute goods and services resulting from any goods, data, information or services obtained or messages received or transactions entered into through, from, or as a result of the website or app; c) unauthorized access to or alteration of your transmissions or data; d) statements or conduct of any user or third party on the website or app; e) your reliance on content data made available by us; or f) any other matter relating to the website or app

Nothing in these terms of use shall exclude or limit our liability for our fraudulent misrepresentation or for death or personal injury resulting from our negligence or the negligence of our employees or agents.

Indemnity

To the full extent permitted under Indian laws, you agree to defend, indemnify and hold harmless Sunday, its officers, founders, directors, and employees from and against all liabilities, demands, claims, damages, complaints, losses, costs, and expenses, including lawyer’s fees, due to, arising out of, or relating in any way to your access to or use of the services, your content, or your breach of this agreement.

Disclaimers

Sunday does not represent or warrant that (a) any matches or profiles presented will be suitable or compatible and/or guarantee success in finding a partner, or that (b) the service will be uninterrupted, secure, or free of errors or bugs, (c) any defects or errors in the service will be corrected, (d) that any content or information you obtain on or through the service will be accurate, or (e) any suggestions or feedback will be incorporated.

Sunday takes no responsibility for any content that you or another user or third party posts, disseminates, or receives through the platform. Any material downloaded or otherwise obtained through the use of the service is accessed at your own discretion and risk.

Sunday takes no responsibility for any conduct of you or any other user, on or off the service.

Miscellaneous

Sunday can be acquired for a part or in whole by another company. This will be done without (written) notice.

If you breach these terms of use and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach these terms of use.

These terms of use are not intended to give rights to anyone except you and Sunday.
